Bernard Bryant ("Bryant") has used the form of Complaint of Employment Discrimination made available for pro se litigants by the Clerk's Office to sue his ex-employer Beautyone Beauty Supply Co. for the asserted violation of his rights under the Americans with Disabilities Act. This memorandum order is issued sua sponte to address the In Forma Pauperis Application ("Application") and Motion for Appointment of Counsel ("Motion")--both of which forms are also supplied by the Clerk's Office--tendered by Bryant along with his Complaint.
Because the Application confirms Bryant's inability to pay the $350 filing fee, it is granted. But because the Motion fails to make the requisite showing of Bryant's efforts to obtain counsel on his own (a precondition established by our Court of Appeals before consideration can be given to the possible appointment of pro bono counsel), it is denied. Finally, this Court is contemporaneously issuing its customary initial scheduling order, including the establishment of an initial status hearing date.
