ORDER FOR DISCLOSURE OF TAX RETURNS AND RETURN INFORMATION
On this 10th day of November 2011, upon the application of the United States Attorney for the Northern District of Illinois for an order, pursuant to 26 U.S.C. § 6103(i)(4)(A)(i) and (ii) to disclose tax returns and return information of Daniel GALLAGHER for the period 2005 through 2009 at trial, in which Daniel GALLAGHER is a named defendant, and after examining the application, this Court FINDS:
There is reasonable cause to believe, based upon information believed to be reliable, that such tax returns and taxpayer information: (1) are relevant in establishing the guilt of the defendant as to the charges of drug conspiracy, in violation of 21 U.S.C. § 846, and engaging in a monetary transaction in property derived from a specified unlawful activity, in violation of 18 U.S.C. § 1957(a); and (2) may be statements of Daniel GALLAGHER within the meaning of Federal Rule of Criminal Procedure 16(a)(1)(B)(i) or may otherwise be discoverable.
IT IS THEREFORE ORDERED that the Government may disclose such tax returns and return information of Daniel GALLAGHER for the period 2005 through 2009 at the trial of such case or any related judicial proceeding.
No disclosure shall be made to any other person except in accordance with the provisions of 26 U.S.C. § 6103(i)(4).
