This matter coming to be heard on the motion of plaintiffs Laborers' Pension Fund and Laborers' Welfare Fund of the Health and Welfare Department of the Construction and James S. Jorgensen, (the "Laborers' Funds") for judgment in an amount certain against RC Smith Concrete Company:
IT IS HEREBY ORDERED:
1. Judgment is entered on behalf of the Laborers' Funds and against defendant RC Smith Concrete Company for a total amount of $12,417.90, which consists of:
a) the amount of $10, 866.90 in late fees based on untimely payment of contributions for the period from July through November 2010;
b) Plaintiffs' reasonable attorneys' fees in the amount of $1,090.00; and
c) Court costs of $461.00.
2. This Court further orders RC Smith Concrete Company to obtain and maintain a surety bond in the amount required by the Union to guarantee the payment of wages, pension and welfare contributions as required by Article IX of the collective bargaining agreement. It is further ordered that within 60 days of the date of this judgment order, RC Smith Concrete Company shall provide written proof that it has obtained such a surety bond to plaintiffs' counsel, Karen I. Engelhardt, Allison, Slutsky & Kennedy, P.C. , 230 W. Monroe Street, Suite 2600, Chicago, IL 60606.
