Thiscausecoming to be heard on Plaintiff's Motion for Entry of Judgment, notice having been given, Defendant having failed to file a Response to Plaintiff's Motion for Partial Summary Judgment and the Court being advised in the premises:
IT IS HEREBY ORDERED as follows:
1. Plaintiff's Motion for Partial Summary Judgment with respect to Count I of Plaintiff's Amended Complaint and with respect to Defendant's Counterclaim is granted;
2. With respect to Count I of Plaintiff's Amended Complaint, judgment is entered in favor of Plaintiff Information Technology Coalition, Inc. and against Defendant Intrinsic Technologies, LLC in the amount of $2,173,490.28, consisting of $1,472,161.25 representing the balance due Plaintiff on its contract with Defendant, together with interest, calculated through February 22, 2011, in the amount of $701,329.03, as provided in Paragraph 4 (e) of the parties' contract;
3. With respect to Defendant's Counterclaim, judgment is entered in favor of Plaintiff-counterdefendant Information Technology Coalition, Inc. and against Defendant-counterplaintiff Intrinsic Technologies, LLC; and
4. Counts II, III and IV of Plaintiff's Amended Complaint are dismissed as moot as a result of the entry of judgment with respect to Count I.
