This cause coming before the Court on the plaintiffs' Motion for Damages, due noticehaving been given to the defendants, and the Court having found that the defendants have been properly served with summons and complaint.
Judgment is entered on behalf of the Laborers' Pension and Welfare Funds and againstdefendants R & W Clark Construction, Inc., Richard W. Clark, and Fortmeyer Construction Co., for a total amount of $160,059.83, which consists of the following:
Principal contributions for the audit period covering July 1, 2006 through December 31, 2008, in the amount of $46,957.04 Liquidate damages in the amount of $9,307.49 Interest $2,406.49 Audit costs $1,105.00
Principal contributions for the audit period covering January 1, 2009 through June 30, 2010, in the amount of $65,538.63
Liquidated damages in the amount of $12,731.90 Interest $3,967.30
Audit costs $1,952.10 Past due penalties $9,703.88 Attorneys' fees $5,895.00 Costs $495.00
In the event that this Company continues to operate, contributions together with remittance reporting information must be paid to the Funds the month after the work has been performed.
