MOTION

Enter Memorandum Opinion and Order. Defendant Graber's motion to dismiss is denied without prejudice. Within 30 days of the date of this order, Warden Graber shall answer the complaint and cause plaintiff to be sent a copy of his medical records relating to his September 2002 injury and indentify MCC staff members who examined or treated plaintiff or participated in treatment decisions. Within ninety days of the date of this order, plaintiff may file an amended complaint naming any additional defendants he believes were deliberately indifferent to his injury and stating what role they played in his treatment. If plaintiff fails to do so, the unnamed defendant will be dismissed and this case will proceed with Warden Graber as sole defendant. Page 1
