04/13/94 PEOPLE STATE ILLINOIS v. PAGE BOOKS

SUPREME COURT OF ILLINOIS

April 13, 1994

PEOPLE STATE OF ILLINOIS, APPELLANT,
v.
PAGE BOOKS, INC., D/B/A BACHELOR'S LIBRARY ADULT BOOKSTORE, APPELLEE

Appeal Appellate Court Second District 2-91-0243, 89CM6929

AUTHOR: PER CURIAM

ORDER

Per Curiam:

In this case, one Justice of this Court has recused himself, and the remaining members of the Court are divided so that it is not possible to secure the constitutionally required concurrence of four Judges for a decision (Ill. Const. 1970, art. VI, sec. 3). Accordingly, the appeal is dismissed. See Perlman v. First National Bank (1975), 60 Ill. 2d 529, 331 N.E.2d 65.

Nickels, J., took no part.
