The December 23, 1985, final decision of the Merit Systems Protection Board, No. NY08318510447, sustaining the Office of Personnel Management's decision denying petitioner's request that it treat petitioner's private railroad service from 1941-1973 as creditable for civil service retirement purposes, is affirmed on the basis of the presiding official's opinion. The decision appealed from was not arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law. See 5 USC 7703(c).

Affirmed.
