UNITED STATES COURT OF APPEALS FOR THE SEVENTH CIRCUIT
February 8, 1984
NATIONAL LABOR RELATIONS BOARD
PERSCHKE, A SOLE PROPRIETORSHIP, DOING BUSINESS AS PERSCHKE HAY & GRAIN
Before BAUER, WOOD, and CUDAHY, Circuit Judges.
The Court has examined the report and recommendation of the Special Master. Upon due consideration, the court affirms and adopts that report and recommendation. It is therefore
Ordered AND ADJUDGED that Kurt A. Perschke is in civil contempt of the judgments of this Court dated September 9, 1976, and July 12, 1978, and it is
FURTHERED ORDERED that Kurt A. Perschke shall purge himself of this contempt by:
1. Fully complying with and obeying each and every term of the Court's September 9, 1976 and July 12, 1978, judgments, and not in any way by action or inaction, commit, engage in, induce, encourage, permit, or condone any violation of said judgments; and
2. Commencing and engaging in negotiations with the National Labor Relations Board, and arriving at an installment payment plan acceptable to the Board, for payment in full of the sum of $45,970.44, plus interest as specified in the Court's judgments of September 9, 1976 and July 12, 1978, less $4,689.03 already collected by the Board. Said installment plan shall be reported to the Court within 30 days from the date this order is received.
IT IS FURTHER ORDERED that, absent bad faith by the Board, upon Perschke's failure to agree upon an installment plan acceptable to the Board, the Court will issue attachment against Kurt Perschke, who shall be incarcerated until the contempt is purged.
