NATIONAL LABOR RELATIONS BOARD, PETITIONER
ABC FREIGHT FORWARDING CORPORATION ET AL., RESPONDENTS.
Before SWYGERT, Chief Judge, STEVENS and SPRECHER, Circuit Judges.
SWYGERT, C.J.: This cause is before this Court upon an application of the National Labor Relations Board for the enforcement of its order issued by it against Respondents, ABC Freight Forwarding Corp., Blue Ribbon Express, Inc., and Midland Forwarding Corporation, their officers, agents, successors and assigns on November 12, 1971. This Court having carefully considered the briefs and transcript of record filed in this cause, and being fully advised in the premises, entered an order on March 5, 1973, granting enforcement of the Board's order.
On consideration whereof, it is ordered and adjudged by the United States Court of Appeals for the Seventh Circuit that the said order of the National Labor Relations Board in said proceeding be enforced, and that the above-named Respondents, their officers, agents, successors and assigns abide by and perform the directions of the Board in said order contained.
It is further Ordered that costs shall be taxed against the Respondents.
Finding sufficient evidence in the record to support the determination by the Regional Director that John G. Burns and John J. O'Connell were not supervisory employees, and therefore that the unit determination was correct, and having considered the briefs submitted by the parties, the order of the Labor Board requiring respondents to bargain with the Union is hereby enforced.
