National Labor Relations Board v. Rauland Division of Zenith Radio Corp.

UNITED STATES COURT OF APPEALS, SEVENTH CIRCUIT.

May 31, 1972

NATIONAL LABOR RELATIONS BOARD, PETITIONER
v.
RAULAND DIVISION OF ZENITH RADIO CORPORATION, RESPONDENT. A1 13-CA-9137; 187 NLRB NO. 103, BROWN/RHOADS.

Before SWYGERT, Chief Judge, STEVENS, and SPRECHER, Circuit Judges.

Order

This case is before the court upon the application of the National Labor Relations Board pursuant to section 10(e) of the National Labor Relations Act, 29 U.S.C. ยง 160(e), for enforcement of its order against Rauland Division of Zenith Radio Corporation entered on January 11, 1971. The Board's decision and order are reported at 187 NLRB No. 103. The Board found that Rauland Division had violated sections 8(a) (1) and (5) of the National Labor Relations Act by refusing to bargain in good faith with the duly certified employee representative.

Upon review of the record and the briefs of the parties and having heard oral argument, we are convinced that substantial evidence supporting the decision of the Board appears in the record viewed as a whole. Universal Camera Corp. v. NLRB , 340 U.S. 474, 488 (1951). Enforcement of the Board's order is therefore granted.
