Wilson & Co. v. National Labor Relations Board

UNITED STATES COURT OF APPEALS, SEVENTH CIRCUIT.

April 27, 1967

WILSON & COMPANY, INC., PETITIONER
v.
NATIONAL LABOR RELATIONS BOARD, RESPONDENT.

Before SWYGERT and CUMMINGS, JR., Circuit Judges and MAJOR, Senior Circuit Judge.

Per Curiam: This court has considered the record in this case transmitted to this court by the National Labor Relations Board, in addition to the briefs filed by the respective parties herein, and has heard oral argument in open court. Having taken the case under advisement for decision, the court has conferred thereon and is now of the opinion, and accordingly holds and adjudges, that the order of the National Labor Relations Board which the petitioner has requested us to review and set aside and which the respondent has requested us to enforce is not supported by substantial evidence in the record as a whole.

Wherefore, the petition to review and set aside the order of the National Labor Relations Board is granted and the cross-petition to enforce said order is denied, and the clerk of this court is directed to enter the judgment of this court accordingly.
